Alliance Defending Freedom International has taken center stage in a landmark legal battle challenging Australia’s online censorship powers, representing a case that has gained attention from the highest levels of US government. The legal advocacy organization is supporting Canadian activist Chris Elston, known as “Billboard Chris,” in his challenge against the Australian eSafety Commissioner’s censorship order that removed a social media post critical of a World Health Organization appointment.
International Implications for Free Speech
The case began when Elston shared an article on the social platform X about the appointment of an Australian transgender activist to a World Health Organization panel. After a complaint was filed with Australia’s eSafety Commissioner, the platform was directed to geo-block the content within Australia. When X initially refused the takedown request, the Commissioner issued a formal removal order with potential penalties of up to A$782,500 (approximately $500,000 USD).
Alliance Defending Freedom International, working alongside Australia’s Human Rights Law Alliance, has taken up Elston’s case to challenge what they view as government overreach in digital speech regulation. The legal team argues that the eSafety Commissioner’s actions represent an alarming expansion of government power to censor protected speech.
“As a father, I have grave concerns about the impact of harmful gender ideology on our children’s wellbeing… we need to be able to discuss it,” Elston stated according to materials from the Human Rights Law Alliance. The five-day hearing for the case began on March 31, 2025, at Australia’s Administrative Appeals Tribunal in Melbourne.
US State Department Weighs In
In a significant development that underscores the international importance of the case, the US State Department’s Bureau of Democracy, Human Rights, and Labor issued a statement expressing concern about Australia’s actions, linking them to broader issues of foreign censorship affecting American companies.
“The Department of State is deeply concerned about efforts by governments to coerce American tech companies into targeting individuals for censorship,” the statement read, specifically mentioning Australia’s actions against Elston. The statement emphasized that “freedom of expression must be protected – online and offline” and warned that censorship “undermines democracy.”
The State Department’s involvement echoes concerns previously raised by Vice President J.D. Vance in his February speech at the Munich Security Conference, where he warned about threats to free speech and democratic values worldwide. Alliance Defending Freedom International’s legal team has noted that the case validates Vance’s warnings about how foreign censorship regimes can impact global speech.
